Olympische Winterspelen en het Olympisch Handvest

Maandag 12 februari 2018. De Olympische Winterspelen in de Zuid-Koreaanse plaats Pyeongchang beginnen vandaag aan hun vierde dag. Nederlandse atleten hebben al vijf medailles behaald: twee gouden, twee zilveren en een bronzen. Voor langebaanschaatsen en shorttrack. De keuze van de plaats en van de beoefende sporten is ingevolge het Olympisch Handvest (Olympic Charter) gemaakt door het Internationaal Olympisch Comité (IOC). Het IOC is een ngo, een non gouvernementele organisatie. Haar rechtsvorm is de vereniging. Haar juridische zetel is het Zwitserse Lausanne. Dit land heeft ook de rechtspersoonlijkheid van de vereniging erkend. Het IOC bestaat volgens het Olympisch Handvest uit drie organen: de algemene (leden) vergadering, het bestuur en de voorzitter. Het is de algemene (leden) vergadering (de Session) die plaats en sporten bepaalt. De algemene (leden) vergadering mag uit maximaal 115 leden bestaan (er zijn momenteel 100 leden), waarvan de meerderheid geen specifieke functie of ambt mag bekleden. Verder moet het bestaan uit enkele atleten en enkele nationale en internationale sportbobo’s. De algemene (leden) vergadering bepaalt binnen dit kader wie zij als nieuw lid toelaat.

Artikel 15 van het Olympisch Handvest luidt (gedeeltelijk): The IOC is an international non-governmental not-for-profit organisation, of unlimited duration, in the form of an association with the status of a legal person, recognised by the Swiss Federal Council in accordance with an agreement entered into on 1 November 2000. Its seat is in Lausanne (Switzerland), the Olympic capital.

Artikel 17 van het Handvest luidt (gedeeltelijk): The powers of the IOC are exercised by its organs, namely 1. the Session, 2. the IOC Executive Board, 3. the President.

Artikel 33 van het Handvest luidt (gedeeltelijk): The election of any host city is the prerogative of the Session.

Artikel 45 van het Handvest luidt (gedeeltelijk): The programme of the Olympic Games is the programme of all sports competitions established by the IOC for each edition of the Olympic Games in accordance with the present Rule and its Bye-law.

Artikel 18 van het Handvest luidt (gedeeltelijk): The Session is the general meeting of the members of the IOC. It is the IOC’s supreme organ. Its decisions are final. The powers of the Session are the following: to adopt or amend the Olympic Charter; to elect the members of the IOC; to elect the host city of the Olympic Games.

Artikel 45 luidt gedeeltelijk: The programme of the Olympic Games is the programme of all sports competitions established by the IOC for each edition of the Olympic Games in accordance with the present Rule and its Bye-law. The programme consists of two components, namely: 2.1 The sports programme, which includes all sports for a specific edition of the Olympic Games, as determined by the Session from among the sports governed by the IFs recognised by the IOC.

Artikel 16 luidt (gedeeltelijk): IOC members are natural persons. The total number of IOC members may not exceed 115. The IOC is composed of: a majority of members whose memberships are not linked to any specific function or office; their total number may not exceed 70; active athletes, the total number of whom may not exceed 15; Presidents or persons holding an executive or senior leadership position within IFs, associations of IFs or other organisations recognised by the IOC, the total number of whom may not exceed 15; Presidents or persons holding an executive or senior leadership position within NOCs, or world or continental associations of NOCs, the total number of whom may not exceed 15. The IOC recruits and elects its members from among such eligible persons as it considers qualified.
