(Van) wie (men) schrijft, die blijft: Lisa Murkowski en ”write in”

DINSDAG 9 OKTOBER 2018 In een Nederlandse krant stond eind september een groot artikel over twee vrouwelijke Republikeinse senatoren wiens stem waarschijnlijk beslissend zou worden voor het al dan niet benoemen van Brett Kavanaugh tot rechter in het Amerikaanse Hooggerechtshof: Lisa Murkowski en Susan Collins. De senaat heeft afgelopen vrijdag en zaterdag Kavanaugh gekozen, met een minieme meerderheid. Collins heeft vóór gestemd maar Murkowski heeft als enige Republikein vrijdag tegen gestemd. Murkowski is senator voor Alaska. Zij is dat al sinds 2004. Ook in 2010 heeft ze de verkiezingen gewonnen. Dat was heel bijzonder, want de officiële kandidaat van de Republican Party was iemand anders (namelijk de Tea Party-kandidaat)

Senate De Senaat bestaat uit 100 leden. De burgers van elke Amerikaanse (deel)staat kiezen twee senatoren. Een senator wordt gekozen voor zes jaar.

Primaries Murkowski was bij de verkiezingen van 2010 niet de officiële kandidaat van de Republican Party (en ook niet van een andere partij). Zij had de voorverkiezingen in de Republican Party verloren van de Tea Party-kandidaat. Daardoor stond ze niet op het stembiljet. Alleen de winnaren van de voorverkiezingen – primaries geheten – in de Republican Party en de Democratic Party staan namelijk op het stembiljet. Er is altijd maar één winnaar bij primaries: dat is de kandidaat die de meeste stemmen heeft gekregen. Republican Party en Democratic Party hebben dus elk één kandidaat op het stembiljet. Er kunnen daarnaast nog andere kandidaten op het stembiljet staan, maar die zijn dan niet verbonden met één van deze twee politieke partijen.

General elections ballot De kiezer geeft op het stembiljet – general election ballot – aan op welke kandidaat hij zijn stem uitbrengt. Hij doet dat door in de daarvoor bestemde (ovale) ruimte naast de naam van die kandidaat bijvoorbeeld een streep, kruis of cirkel te maken. In Alaska is er wat betreft het stemmen op een kandidaat dus meer ”handelingsvrijheid” dan in Nederland waar hij alleen een daarvoor bestemd wit stipje rood mag kleuren!

Write in De Amerikaanse kiezer mag er in het stemhokje ook voor kiezen om de naam van een ander op het stembiljet te schrijven, een ander iemand dan de kandidaten dan de namen van de kandidaten die op het stembiljet gedrukt staan. Daarvoor is een speciale plek gereserveerd op het stembiljet. De kiezer die hiervoor kiest moet bovendien een streep, kruis of cirkel maken in de daarvoor bestemde (ovale) ruimte ernaast. De kiezer die dit doet, maakt een write in vote. Eigenlijk moet de opgeschreven naam volledig zijn en helemaal juist zijn gespeld, maar als dit niet het geval is en toch duidelijk is wie de kiezer bedoelt, dan telt zijn stem gewoon mee. Het is evenwel expliciet verboden om een sticker met daarop de volledige naam op het stembiljet te plakken! Voor de volledigheid: write in votes kunnen alleen (geldig) worden uitgebracht op mensen die hebben verklaard dat ze daarvoor open staan.

Senator De persoon die de meeste stemmen heeft gekregen, heeft de senaatsverkiezingen gewonnen. Dat kan dus iemand zijn wiens naam als kandidaat was voorgedrukt op het stembiljet. Maar het kan ook een ander iemand zijn wiens naam op het stembiljet door de kiezer in het stemhokje is bijgeschreven. Dat is Lisa Murkowski overkomen in 2010. Haar naam stond niet voorgedrukt op het stembiljet maar ze heeft dankzij write in votes toch de meeste stemmen gekregen. Dat lijkt me een bijzondere prestatie!

BRONNEN

Section 3 van de Constitution of the United States luidt (gedeeltelijk): The Senate of the United States shall be composed of two Senators from each State, chosen by the Legislature thereof, for six Years; and each Senator shall have one Vote.

Article XVII (Amendment 17) luidt gedeeltelijk: The Senate of the United States shall be composed of two Senators from each State, elected by the people thereof, for six years; and each Senator shall have one vote. The electors in each State shall have the qualifications requisite for electors of the most numerous branch of the State legislatures.

Artikel 15.25.100 van de Alaska Statutes luidt: The director shall place the name of the candidate receiving the highest number of votes for an office by a political party on the general election ballot.

Artikel 15.25.010 luidt (gedeeltelijk): Candidates for the elective national legislative offices shall be nominated in a primary election by direct vote of the people in the manner prescribed by this chapter. A voter registered as affiliated with a political party may vote that party’s ballot. A voter registered as nonpartisan or undeclared rather than as affiliated with a particular political party may vote the political party ballot of the voter’s choice unless prohibited from doing so under AS 15.25.014. A voter registered as affiliated with a political party may not vote the ballot of a different political party unless permitted to do so under AS 15.25.014.

Artikel 15.15.360 luidt: (a) The election board shall count ballots according to the following rules:

(1) A voter may mark a ballot only by filling in, making “X” marks, diagonal, horizontal, or vertical marks, solid marks, stars, circles, asterisks, checks, or plus signs that are clearly spaced in the oval opposite the name of the candidate, proposition, or question that the voter desires to designate.

(5) The mark specified in (1) of this subsection shall be counted only if it is substantially inside the oval provided, or touching the oval so as to indicate clearly that the voter intended the particular oval to be designated.

(b) The rules set out in this section are mandatory and there are no exceptions to them. A ballot may not be counted unless marked in compliance with these rules.

(d) Write-in votes shall be counted according to the following rules:

(2) in order to vote for a write-in candidate, the voter must write in the candidate’s name in the space provided and fill in the oval opposite the candidate’s name in accordance with (a)(1) of this section;

(3) a vote for a write-in candidate shall be counted if the oval is filled in for that candidate and if the name of the candidate, as it appears on the write-in declaration of candidacy, or the last name of the candidate is written in the space provided;

(5) in counting votes for a write-in candidate, the director shall disregard any abbreviation, misspelling, or other minor variation in the form of the name of a candidate if the intention of the voter can be ascertained.

Artikel J 26 (Nederlandse) Kieswet luidt (gedeeltelijk): De kiezer gaat na ontvangst van het stembiljet naar een stemhokje en stemt aldaar door een wit stipje, geplaatst vóór de kandidaat van zijn keuze, rood te maken.

Artikel 15.15.361 Alaska Statutes luidt: Affixing stickers on a ballot in an election to vote for a write-in candidate is prohibited.

Artikel 15.15.365 luidt: (a) Write-in votes on a general election ballot shall be counted for a candidate only if the aggregate of all votes cast for all write-in candidates for the particular office is

(1) the highest number of votes received by any candidate for the office; or

(2) the second highest number of votes received by any candidate and the difference between the total number of votes received by the candidate having the highest number of votes and the aggregate of all votes cast for all write-in candidates for the office is less than the percentage necessary for a recount at the state’s cost under AS 15.20.450.

(b) Write-in votes that do not meet the requirements of this section may not be individually counted under this section.
