Donderdag 18 januari 2018. De ambassade van de Verenigde Staten wordt verplaatst van Den Haag naar Wassenaar. Wat is de juridische betekenis in Nederland van een ambassadeterrein en de gebouwen die erop staan? Dat is geregeld in het Verdrag van Wenen inzake diplomatiek verkeer. Op grond van dat verdrag mogen de Nederlandse autoriteiten ambassadeterrein en gebouwen daarop niet betreden, ook niet als er een misdrijf is gepleegd. Bij Nederlandse autoriteiten gaat het bijvoorbeeld om Nederlandse rechters, politie, soldaten, gemeenteambtenaren (milieu en woningtoezicht!) of deurwaarders. Het maakt daarbij niet uit als de ambassade huurt van de Nederlandse overheid of een Nederlandse particulier. Evenmin mogen dit terrein, deze gebouwen en de meubels of andere roerende zaken aan onderzoek worden onderworpen. Betreding en onderzoek zijn alleen toegestaan met toestemming van de ambassadeur. Zelfs de privéwoning van de ambassadeur mag zonder diens toestemming niet worden betreden of onderzocht. Nederland is verplicht om privéwoning, ambassadeterrein en ambassadegebouwen proactief te beschermen.
Artikel 22 van het Verdrag van Wenen inzake diplomatiek verkeer luidt: The premises of the mission shall be inviolable. The agents of the receiving State may not enter them, except with the consent of the head of the mission. The receiving State is under a special duty to take all appropriate steps to protect the premises of the mission against any intrusion or damage and to prevent any disturbance of the peace of the mission or impairment of its dignity, The premises of the mission, their furnishings and other property thereon and the means of transport of the mission shall be immune from search, requisition, attachment or execution.
Artikel 1 aanhef en onder i van het verdrag luidt: For the purpose of the present Convention, the following expressions shall have the meanings hereunder assigned to them: the “premises of the mission” are the buildings or parts of buildings and the land ancillary thereto, irrespective of ownership, used for the purposes of the mission including the residence of the head of the mission.
Artikel 30 lid 1 van het verdrag luidt: The private residence of a diplomatic agent shall enjoy the same inviolability and protection as the premises of the mission.
Artikel 1 aanhef en onder e van het verdrag luidt: For the purpose of the present Convention, the following expressions shall have the meanings hereunder assigned to them: a “diplomatic agent” is the head of the mission or a member of the diplomatic staff of the mission.
